KAFUE COUNCIL SUED

KAFUE District Council has been sued for illegal repossession of small holdings allocated to two private residents in the area.

Longwani Mwepu and Johnson Zulu, both from Kasengele area of Kafue have asked the Lusaka High Court for an interim injunction against the repossession of land duly allocated to them in 1998.

According to the claims filed before court, the two complained that owing to the personal interests of a named local councilor, the council revoked their ownership of the small holder plots they owned upto 2010, which resulted in the demolition of a house constructed on the land.

“Confusion began in 2011 when a new councilor was elected by the name of Upendo Nyendwa who began to demand that we surrender the land to him,” they explained.

They have submitted that Mr Nyendwa then began to demarcate the areas into smaller plots for residential plots for other people who commenced construction of structures, which shocked the two as the councilor earlier claimed they were meant for farms.

They have since requested for an order to declare the small holdings plots theirs, and also an order to direct Kafue district council to issue tittle deeds to them as original owners, including damage for inconvenience and mental anguish caused to them as a result.

Meanwhile, Oriental Quarries has been sued for over K300, 000 by a former accountant in unpaid salary arrears and accrued gratuity for the period before his resignation in February, 2017.

According to a statement of claim filed in the Lusaka High Court, Fredrick Mukuka is claiming K313, 686.10 in total including unpaid industrial break allowances, and accrued leave pay all in relation to the period he worked for Oriental Quarries from 2014 to 2017.

He explained that his resignation letter indicated demands for unpaid salaries and other emoluments amounting to over K300, 000 which has not been paid to him for six months.

“Despite admission of the said debt, Oriental has refused or neglected to settle the amount,” he claimed.
