KAMBWILI, SON, OTHERS PUT ON DEFENCE

FORMER National Democratic Congress (NDC) president Chishimba Kambwili, his son Mwamba and three others have been found with a case to answer for making a false document and uttering it to two companies.

In this case, Kambwili, Mwamba, two Zambia Revenue Authority (ZRA) employees Mulenga Kapilima and Brano Lukwesa Musonda; and Mwamona Engineering Technical Services (METS) have been charged with making a false ZRA tax clearance, which they allegedly uttered to Zesco Limited and China Henan International Corporation (CHICO) to obtain contracts worth millions of Kwacha with intent to deceive.

They have also been charged with obtaining pecuniary advantage by obtaining the two contracts using the same false tax clearance certificate; and 34 counts of possessing over K6 million reasonably believed or suspected to be proceeds of crime.

High Court Judge Mwaka Mikalile, who sits as Principal Resident Magistrate in the matter, yesterday found the accused with a case to answer after being satisfied that the State has sufficient evidence warranting them to be put on their defence.

Ms. Justice Mikalile set May 17, 2021 as the date for Kambwili and his co-accused to open their defence.

It is alleged that Kambwili and his son Mwamba uttered the false tax clearance certificate number 012MK dated May 4, 2014 to Zesco Limited for the award of the contract worth K1, 652, 482.81.

Kambwili and METS have also been charged for obtaining pecuniary advantage after dishonestly getting US$105, 220.07 from the subcontractor China Henan International Corporation Group Limited by means of false pretence.

It is alleged that between August 1, 2014 and September 30, 2016, Kambwili and METS purported that the latter was executing works on the Mansa-Luwingu road, on behalf of the Chinese firm, when in fact not.
