Guard sues pastor for wrongful dismissal

A SECURITY guard has sued the Redeemed Christian Church of God and its pastor in the Lusaka High Court demanding damages for wrongful dismissal.

According to a statement of claim, Mr Sydney Musonda has sued Pastor Patrick Osagie and the church for claiming that he had neglected his duties which allegedly led to his dismissal from employment.

Mr Musonda says he was employed as a security guard at the church on April 3, 2013 and he worked for three years.

He claims that Pastor Osagie obregated the labour laws by his failure to pay him housing,  lunch and holiday allowances as well as salary underpayment, contrary to Minimum Wages and Conditions Act Cap 286 and Employment Act Cap 269 of the laws of Zambia.

He alleged that Pastor Osagie maliciously obregated the labour laws by terminating his employment and that both the church and the pastor infringed on his right. Mr Musonda claimed that his name was brought into public ridicule, odium and he suffered loss of reputation when the defendants accused him of having been negligent with his duties which allegedly led to his dismissal.

Mr Musonda wants the court to order damages for mental torture, stress and disturbances emanating from his malicious unlawful dismissal.

He also wants damages for malicious accusation of theft at the same church and damages for underpayment of his dues, including cost for action and any other reliefs the court may deem fit.
