Matero losing UPND candidate runs to ConCourt

LOSING UPND candidate Tom Michelo has turned to the Constitutional Court appealing against the High Court’s declaration of Miles Sampa as duly elected Matero Member of Parliament, alleging there was clear evidence of electoral malpractice.
High Court Judge Derrick Mulenga dismissed Mr Michelo’s petition on ground that he failed to prove the electoral malpractices allegations levelled against Mr Sampa.
Mr Justice Mulenga said that the request by Mr Michelo for an order that ballot papers be scrutinised, verified and be recounted was not supported by any evidence.
Mr Michelo got 33, 598 against Mr Sampa who polled 55, 612 votes in the elections held on August 12, this year.
But according to a Memorandum of Appeal filed yesterday in ConCourt, Mr Michelo has raised over 10 grounds of appeal which include among them that the trial judge did not follow the law when he ignored and disregarded the overwhelming evidence of acts of violence laid before him.
He stated that instead, the judge held that there was no evidence to show that acts of violence were widespread and prevented the majority of voters in the constituency from electing the candidate of choice.
