Man fined K10, 000 for impregnating woman (20)

A LOCAL Court in Lusaka has ordered a 31-year-old man to pay K10, 000 as compensation for deflowering and impregnating a 20-year-old woman.

This was in a case in which Charles Phiri, 56, of Barastone compound sued James Parkinson Junior of Lusaka West for allegedly deflowering and impregnating his daughter, Theresa Phiri.

When the claim was read, James denied the charge.

Phiri told Senior Court Magistrates Miyanda Banda, Pauline Newa and Ronnie Shafwensha at Matero Local Court that in 2015 Theresa stopped going to school and that she could come home at 18 hours smelling beer or not come back.

He explained that Theresa spent a month out and that this year she was discovered pregnant adding that she went missing and she since has a one month and five days old baby.

In defence, James said that he has never been in relationship with Theresa and that he never made love to her.

He said that he was surprised when Phiri brought a call out that Theresa was missing.

Theresa testified that James was her boyfriend and that they started relationship in 2014 and that when she discovered she was pregnant they went with James to do a pregnancy test.

She testified that they were meeting in Paradise compound where James was renting a house adding that he was the only man she made love with.

In submission, James after he saw a light baby maintained that he was not responsible of Theresa’s pregnancy and that he used to see her with many coloureds and whites.

The court was satisfied with Theresa’s testimony and found James guilty of her pregnancy and ordered him to pay a fine with the initial payment of K1, 500 followed by K400 per month and that if he still doubted he should go for DNA test.
