Court declares Chisenga as duly elected Mambilima MP

THE Constitutional Court has declared Jean Chisenga of the Patriotic Front (PF) the duly elected Member of Parliament for Mambilima Constituency.
The court in its judgement delivered by Judge Martin Musaluke said it could not fault the High Court’s decision because UPND losing candidate Chileshe Mpunga Chilufya had failed to adduce evidence to warrant the nullification of the election as required by section 97 (2) of the Electoral Process Act.
Justice Musaluke said Mr Chilufya failed to prove that developmental projects which included paying school fees for girls, refurbishing hospitals, roofing of churches amounted to bribery and induced the electorates not to vote for their preferred candidate.
An elated Ms Chisenga said the court proceedings had been a hinderance to her work.
Mr Chilufya in his memorandum of appeal said High Court Judge Yvonne Chembe misdirected herself in fact and law by holding that the self-confessed development projects carried out by Ms Chisenga in Mambilima Constituency at the peak of the campaigns were charitable works and were not done with a view to induce voters to vote for her.
He said that the trial Judge misdirected herself in fact in holding that he was also involved in charitable work when no evidence was adduced to that effect.
